Data Protection & GDPR
When we undertake an assignment on behalf of a client we aim to comply with data protection legislation and the General Data Protection Regulation (GDPR). This information should be read in conjunction with our Privacy Policy.
Photos that directly or indirectly identify an individual are deemed to be personal data under GDPR. In addition we often collect personal data to identify individuals in photos to ensure the photos meet industry standards. This information is embedded within the photos as a caption. We have a duty to collect, hold and share such data in a way that protects the privacy of the people we photograph.
Clients have responsibility to ensure the people we are commissioned to photograph are aware of how their data will be used. For instance, when we are commissioned to cover an event, clients should consider the use of notices to inform people their photograph may be taken and where it may be used.
When we brief our photographers they are made aware of their own responsibilities under the legislation to ensure high data protection standards are met from the moment the data is created.
Clients they have a duty to ensure the photos and associated data shared with them is treated in line with their own data protection and GDPR policies.
We are registered with the Information Commissioners Office under reference ZA330262, which is the UK independent authority set up to uphold information rights in the public interest, promoting openness by public bodies and data privacy for individuals.
Client Terms & Conditions
All assignments are covered by these Terms & Conditions unless otherwise agreed in writing and signed by a director.
Your booking
Once an assignment is confirmed, in writing or verbally, we will charge 50% of the quoted rate if the shoot is subsequently cancelled. If an assignment is cancelled within 48 hours of the start time, the total fee will be payable.
If we require a Purchase Order number for invoicing, this should be provided at the time of confirmation of the assignment.
Terms of payment
All invoices are payable 30 days from invoice date.
Clients unable to pay within these standard terms should specify at time of booking a requirement to have terms of payment extended to 60 days. We will extend terms and add 10% to the invoice total. This increase must be agreed at the time of confirmation of the booking or our standard 30 day terms will be applicable.
Failure to pay within our standard terms will be seen as a request for terms to be extended and 10% will be added to outstanding invoices once they are 30 days overdue and all future invoices.
Copyright
We do not relinquish copyright. On full payment of the invoice, clients are granted a licence to use final images for unlimited editorial or advertising usage worldwide.
We reserve the right to use any photograph on our website or to promote our work in other marketing material. Commissioned images and embedded data will not be made available to third parties without the express permission of the client. Commissioned images will not be sold to third parties.
Currency & VAT
All prices are in sterling. VAT will be added at the current rate.
Legal
We reserve the right at any time, in our sole discretion, to make any changes to these Terms & Conditions. Any changes will be notified to you by publishing the revised Terms & Conditions on this website. By booking an assignment after such notification you agree to be bound by such changes.
These Terms of Use are to be interpreted in accordance with English law and in the event of any dispute you and we irrevocably submit to the exclusive jurisdiction of the English courts.
Finally, nothing in these Terms of Use is to be interpreted as an attempt to limit or exclude our liability for any personal injury resulting from our negligence and, if you are a consumer, nothing we say affects your statutory rights.
